Avichal The NCTE, disregarding the proviso under Section 23(2) of the RTE Act, 2009, exercised the powers granted under Section 23(1) of the RTE Act, 2009, and through its Notification dated 23/08/2010, Para 1, prescribed the minimum qualifications for appointment of teachers. According to this notification, teachers appointed before 23/08/2010 were exempted from possessing minimum qualifications under Para 4, and in Para 5, it was decided that recruitments made pursuant to advertisements issued before 23/08/2010 would continue to be governed under the NCTE Regulations, 2001. Subsequently, in 2011, the Central Government strengthened the powers of NCTE further. अविचल  एनसीटीई ने RTE एक्ट 2009 के सेक्शन 23(2) के परन्तुक की परवाह न करते हुए RTE एक्ट 2009 के सेक्शन 23(1) में मिली शक्ति के बल पर 23/08/2010 के नोटिफिकेशन के पैरा एक में न्यूनतम योग्यता निर्धारित की। इसके अनुसार दिनांक 23/08/2010 के पूर्व नियुक्त हो चुके शिक्षकों को पैरा 4 में न्यूनतम योग्यता धारण करने से मुक्त किया गया और पैरा 5 में दिनांक 23/08/2010 के पूर्व जारी हो चुके विज्ञापनों को NCTE के विनियम, 2001 से जारी रखने का निर्णय लिया गया। इसके बाद वर्ष 2011 में केंद्र सरकार ने एनसीटीई को और मजबूत बना दिया। NCTE ने सुपर सीनियर शिक्षक और सीनियर शिक्षक को RTE के दायरे में धीरे-धीरे लाने का प्रयास किया, क्योंकि NCTE RTE एक्ट लागू होने के पूर्व नियुक्त और विज्ञापित शिक्षकों के प्रति सहानुभूति रखती थी तथा उन्हें RTE एक्ट के कठोर नियमों से बचाए रखना चाहती थी। इसके अलावा संविधान के अनुच्छेद 16 से सुरक्षित किसी शिक्षक की सेवा पर प्रश्नचिह्न नहीं लगाना चाहती थी। मगर जब NCTE ने दिनांक 12/11/2014 के नोटिफिकेशन के पैरा 4(बी) में सुपर सीनियर शिक्षक और सीनियर शिक्षक को भी पदोन्नति में जिस संव...
